We operate an online platform which enables you to control and optimise your subscription payments. Our platform includes tools to:
(a) collect and track financial information on all your transactions and payments for the purpose of identifying your subscriptions;
(b) conduct comparisons of subscription pricing and value which is offered by third party vendors as generally available in the market;
(c) switch your subscription to alternative providers or offerings with your current providers (at your discretion) to get better value for your subscriptions; and
(d) manage various aspects of your subscriptions including, where possible, termination.
(e) while Paylow aims to facilitate a seamless switching experience, you are responsible for confirming the cancellation of your previous service. We recommend contacting your old provider to avoid any potential overlaps or charges.
We use a tool provided by TrueLayer Limited (www.truelayer.com)(“TrueLayer”) to gain access to your bank account information.
TrueLayer is authorised and regulated by the Financial Conduct Authority as an Electronic Money Institution under the Payment Services Regulations 2017 and the Electronic Money Regulations 2011(Firm Reference Number: 901096). We act as TrueLayer’s EMD Agent, which means that we can access and show you your account information on behalf ofTrueLayer.
TrueLayer’s terms and conditions apply when you ask us to access your bank account information. Their terms are available at truelayer.com/legal/enduser_tos).
In using Paylow services you agree that TrueLayer can access and view your bank account information and you accept their terms and conditions.

To use our platform, you need to create an account with us and authorise us to access and import your bank account information, including your transactions. You have to be at least 18 to do this. Only you can use your own account and you must notify us immediately if you suspect any unauthorised access or use of your account using the contact details set out in "About Paylow".
You must always keep any device used to access your Paylow account secure and not share them with anyone, including with anyone you have a joint bank account with. You must also make sure that only biometric information (such as your fingerprint when using Touch ID) relating to you is registered on any devices you use to access Paylow. We’ll never phone, text or email you asking for your Paylow login details.
The terms and conditions you have with banks and payment service providers for your accounts should allow you to share your online login details with True Layer, who will in turn share them with us. If not, you should check that they are happy for you to share this information with TrueLayer and us.
If any of the accounts you add are joint accounts, you need to make sure you've informed the other account holder (s) how this information will be used, and that they’ve authorised you to consent to this on their behalf.
When you create a Paylow account, you agree to the terms. These terms govern your use of our website, app and any related services.
References to "you" in the Terms means you or, if you choose to view information from a joint bank account, you and any other individuals named on that bank account.
Your right to access and use our services is personal to you and isn’t transferable.
Our Privacy Policy (https://www.paylow.app/privacy-policy) explains how we’ll use your personal information and sets out our rights and obligations in relation to relevant data protection laws. By agreeing to these terms, you also explicitly consent to us accessing, processing, and retaining any personal data we get as a result of providing this service to you.
If you wish to end this agreement or withdraw consent for us to process your data, we will stop using your data in this way. However, we may need to keep processing some of your data where the law requires us to do this, for example where we are legally required to keep records of transactions.
TrueLayer also has its own privacy policy (truelayer.com/privacy) which applies when you allow TrueLayer to access your bank account information. You should read their policy and make sure you agree to it before you allow them to access your bank account information.
We don’t charge you for using Paylow but we may receive commission payments from vendors we introduce you to. The type or amount of commission we receive does not impact the way we present and display the vendors and their products to you.
Unless we expressly consent to you doing so, you agree not to do, or allow any third party to do, any of the following:
(a) copy or reproduce the services;
(b) make the services available to someone else, including but not limited to selling, assigning, leasing, lending, or licencing the services;
(c) circumvent, disable or otherwise interfere with security-related or technical features of our platform, such as features that restrict or monitor use of the platform;
(d) copy, modify, translate, reverse engineer, decompile, disassemble, make any attempt to discover the source code of any of our services and/or any other software available on the website;
(e) disclose to any third party the results of any internal performance testing or benchmarking studies of or about our services; or
(f) use our services to develop a competing service or product.
While we want you to be able to use Paylow whenever you want, occasionally repairs, updates and maintenance on our systems may mean some or all of our services won't be available for a while, or may mean our services are slow for a short time. If you suffer a loss because of this, we won't be responsible for that loss.
Although we'll always try and give you the best service possible, we aren’t responsible for any loss or damage you suffer if we can't perform our obligations under this agreement because of any:
(a) Legal or regulatory requirements; or
(b) Unforeseeable or unusual circumstances which are outside our (or our agents’ and/or subcontractors’) control and which we couldn’t have avoided despite all efforts to prevent it – for example, industrial action or mechanical failure.
We'll be responsible for any loss or damage you suffer if it’s a predictable outcome of us breaching this agreement, or if we fail to protect your information and keep it secure as required by relevant law(s). We’ll also be responsible for any obligation we've breached if we can't limit or exclude that obligation as a matter of law.
Our platform may contain content provided by third parties and links to outside services and resources. We are not responsible for any consequences of you leaving our platform to visit external content and you should direct any concerns to the content provider. The third party content we display on our website is there for informational purposes and we do not create or produce it.
We may make changes or add to these Terms from time to time. We can change this agreement for a reason set out below. If we do change this agreement, the change we make will be a reasonable and proportionate response to a change that is affecting us or that we reasonably think will affect us:
(a) to respond to a change, or a reasonably anticipated change, in regulatory requirements –for example, if the law changes, or our regulator changes its rules or provides updated guidance;
(b) to reflect a change in the cost of providing our services;
(c) to reflect changes we have made to our services; or
(d) to do something that is to your advantage.
As this agreement has no fixed end date, we may also need to make changes to this agreement for other reasons that we can't predict right now, but we'll always explain the impact that change will have on you.
If we make changes, we will let you know at least 30 days before we make the change by sending you an email or a message through your Paylow account. Your notice period will start from the date we let you know about the change.
If you are unhappy with the changes, you can close your Paylow account immediately and without any penalty until the end of the notice period. If you would like to close your account, please go to your Paylow account’s Settings page and activate the “delete account” feature. Contact us before the day the changes take effect. If you do not let us know you want to close your account by then, we will assume that you have accepted the changes.
This agreement will continue until you or we end it.
You can end this agreement at any time without explanation or charge by contacting us using the contact details set out in "About Paylow".
We can end this agreement and your use of the service at any time without giving you a reason by giving you at least 30 days’ notice.
We can also immediately suspend, restrict or stop your use of our services if:
(a) You've seriously or repeatedly broken theseTerms;
(b) We've reason to believe that you are engaging in, or facilitating, illegal activity;
(c) You've provided us with false or materially incomplete information;
(d) You've allowed someone else to use the services to access your data;
(e) You've behaved improperly towards us (for example, you've been threatening, abusing or harassing a member of staff);
(f) You've caused us to, or may cause us to, break a law, regulation, code, or other requirement, obligation or duty that applies to us; or
(g) There's been, or we suspect there's been, a breach of security or misuse of the services.
These Terms are governed by and construed in accordance with the laws of England and Wales. Any dispute that arises regarding this agreement will be dealt with by any court in the United Kingdom that is able to hear the case.
· If any provision of these terms is held to be unenforceable, that provision will be disregarded but the remainder of the agreement will continue to apply;
· These terms are the entire agreement between you and us;
· We may assign these terms, in whole or in part. You are not entitled to assign or otherwise transfer the terms, or any of your rights or obligations, to any third party without our prior written consent;
· Our failure to enforce any provision of these terms or to take action against you in the event of a breach is not a waiver of those rights by us; and
· All waivers must be in writing.

If we need to contact you, we’ll normally do this via email. We'll also get in touch with you in any other way that is personal to you. This may include SMS, online notifications or any other appropriate messaging service.
Please tell us if your name or contact details change, including any email addresses, mobile phone numbers or other contact details, so we can keep in touch. If you don’t, we won’t be responsible if you don’t get any information or notices from us.
We want to provide you with the best service we possibly can, so if you have a suggestion for how we can improve, or you're disappointed with our service, we want to hear from you. Get in touch using the contact details set out in "Communicating with us".
We'll try to resolve any issues to the best of our ability, but if you're not happy with our response and your complaint relates to our account aggregation service, you might be able to refer your complaint to the Financial Ombudsman using the contact details below.
